Gay Head Land Purchase, Zoning Changes: Aquinnah Special Town Meeting Warrant, Nov. 5, 2013

See what's coming before voters at the Aquinnah special town meeting Tuesday night.

Aquinnah holds a special town meeting Tuesday at 7 p.m. at Old Town Hall to act on the following matters, as listed in the town meeting warrant:

ARTICLE ONE
Board of Selectmen

To see if the Town will vote to appropriate from free cash the sum of $40,000.00 (Forty thousand dollars), to be put into the general stabilization fund, or take any other action relative thereto.

ARTICLE TWO
Department of Public Works

To see if the Town will vote to appropriate the sum of $5,000.00 (Five thousand dollars) from the Buildings & Grounds Stabilization Fund to do an engineered landscape site plan for remedial alterations of the Circle walkway to the restrooms, or take any other action relative thereto.

ARTICLE THREE
Fire Department

To see if the Town will vote to appropriate from free cash the sum of $20,000.00 (Twenty thousand dollars) to purchase four (4) Self Contained Breathing Apparatus and a pack tracker device and any other equipment necessary to make the above equipment function, or take any other action relative thereto.

ARTICLE FOUR
Board of Assessors

To see if the Town will vote to appropriate the sum of $2,500.00 (Two thousand five hundred dollars) to be expended by the Board of Assessors for the fiscal year 2014 interim revaluation of real property, and to transfer that amount from the unexpended balances of $1,275.00 (One thousand two hundred seventy five dollars) in STM 5-8-12, Article 8 (Reprogramming Radios), $750.00 (Seven hundred fifty dollars) in STM 2-21-06, Article 4 (Wind Turbine Advisor), and $475.00 (Four hundred seventy five dollars) in STM 5-8-12, Article 4 (Repaving Fire House Driveway Area), or take any other action relative thereto.

ARTICLE FIVE
Board of Selectmen

To see if the Town will purchase Map 6, Lot 23 for the sum of $32,000.00 (Thirty Two Thousand Dollars), or take any other action relative thereto.

ARTICLE SIX
Community Preservation Committee

To see if the Town will vote to appropriate monies from existing Community Preservation revenues, for the undertaking of the following Recreational efforts, as recommended by the Community Preservation Committee:

$35,000 (thirty-five thousand dollars) from the Community Preservation Open Space and Recreation Reserve for expenses related to the purchase of Map 6 Lot 23 for Recreational purposes related to the continuing use, history, and public access to the Gay Head Lighthouse.

ARTICLE SEVEN
Community Preservation Committee

To see if the Town will vote to appropriate monies, from existing Community Preservation Undesignated Reserves, for the undertaking of the following Historic Preservation efforts, as recommended by the Community Preservation Committee:

$15,000 (fifteen thousand dollars) for the continuing restoration of the Edwin DeVries Vanderhoop Homestead, including, but not limited to, the painting of exterior trim and restoration of exterior railings.

ARTICLE EIGHT
Library Trustees

To see if the Town will vote to appropriate from the Buildings & Grounds Stabilization Fund the sum of $3,000.00 (three thousand dollars) to add cabinet doors and shelving in kitchen area as well as replace the sink in The Old Schoolhouse, or take any other action relative thereto.

ARTICLE NINE
Library Trustees

To see if the Town will vote to appropriate from free cash the sum of $5,000.00 (five thousand dollars) to paint and repair exterior trim in The Old Schoolhouse, or take any other action relative thereto.

ARTICLE TEN
Library Trustees

To see if the Town will vote to appropriate from the Buildings & Grounds Stabilization Fund the sum of $5,000.00 (five thousand dollars) to upgrade and replace all storm windows in The Old Schoolhouse, or take any other action relative thereto.

ARTICLE ELEVEN
Planning Board

To see if the Town will vote to amend the Aquinnah Zoning By-Laws as follows:
1.) Amend Sections 13.4-10 and 3.7-1 (Minimum Frontage) by deleting the existing Section B and adding the following as Sections B, C, D, E and F
B. The Planning Board Plan Review Committee shall have the authority to modify or vary the 200 foot frontage requirement by Special Permit for: i) the reconstruction, extension, or alteration of pre-existing, conforming or nonconforming structures in existence as of May 10, 2011, situated on lots with nonconforming frontage, under the standard contained in Section 13.4-11(A.); and ii.) the addition of new structures, which themselves comply with all other dimensional and density criteria contained in the Zoning By-laws, and receive all other Special permits required by the Zoning By-laws, on lots with nonconforming frontage which have been improved with at least one single family residence as of May 10, 2011.

C. The Planning Board Plan Review Committee shall have the authority to modify or vary the 200 foot frontage requirement by Special Permit for the addition of otherwise conforming single family homes, and permitted accessory structures, on lots where the owner has constructed or installed facilities, which have been previously duly permitted by the governing Town board, committee, commission, or official, such as a well, a septic system, or an access road, between June 17, 1999 and May 10, 2011.

D. The Planning Board Plan Review Committee shall have the authority to modify or vary the 200 foot frontage requirement by Special Permit for the construction of single family residences and related accessory structures on Resident Homesite Lots provided for by Section 13.12.

E. The Planning Board Plan Review Committee shall have the authority to modify or vary the 200 foot frontage requirement by Special Permit for the construction of single family residences and related accessory structures on lots developed under the Compact Siting provisions of Section 3.3-2.

F. The Planning Board Plan Review Committee shall have the authority to modify or vary by Special Permit the 200 foot frontage requirement for undeveloped lots with nonconforming frontage, but that have at least fifty (50) feet of frontage, on an existing public or private way as of May 10, 2011.

ARTICLE TWELVE
Board of Selectmen

To see if the Town will vote to appropriate the sum of $1,168.00 (One thousand one hundred sixty eight dollars) for a prior year public restroom repair bill, and to transfer that amount from the unexpended balance in STM 5-14-13, Article 1 (New Philbin Beach Shed), or take any other action relative thereto. (9/10ths VOTE REQUIRED)

ARTICLE THIRTEEN
Board of Selectmen

To see if the Town will vote to raise and appropriate the sum of $1,500.00 (one thousand five hundred dollars) to purchase 3 picnic tables and 3 park benches for the Aquinnah Circle, or take any other action relative thereto.

ARTICLE FOURTEEN
Public Works Department

To see if the Town will vote to appropriate the sum of $600.00 (Six hundred dollars) to purchase an office computer, and to transfer that amount from the unexpended balance in STM 5-08-12, Article 9 (Town Hall Defibrillators), or take any other action relative thereto.

ARTICLE FIFTEEN
Board of Selectmen

To see if the Town will vote to appropriate the sum of $150.00 (One hundred fifty dollars) for a prior year public restroom repair bill from Israel’s Plumbing, and to transfer that amount from the unexpended balance in STM 5-14-13, Article 1 (New Philbin Beach Shed), or take any other action relative thereto. (9/10ths VOTE REQUIRED).

ARTICLE SIXTEEN
Board of Selectmen

To see if the Town will vote to appropriate from the Buildings & Grounds Stabilization fund the sum of $7,200.00 (Seven thousand two hundred dollars) to re-carpet the Town Hall offices and meeting rooms, or take any other action relative thereto.

ARTICLE SEVENTEEN
Board of Selectmen

To see if the Town will vote to appropriate the sum of $2,100.00 (Two thousand one hundred dollars) for the shared cost of stakeholder’s meetings between Aquinnah and Chilmark for a bathymetric data analysis and hydrodynamic modeling of Menemsha Pond proposed dredging locations, and to transfer that amount from the unexpended balance in STM 5-11-10, Article 4 (Old Accounting Software), or take any other action relative thereto.

ARTICLE EIGHTEEN
Library Director
To see if the Town will vote to appropriate the sum of $146.45 (One hundred forty-six dollars and 45 cents) for library use and to transfer the balance remaining in the County Dog Fund for that purpose, or take any other action relative thereto.
